各地級以上市(shi)人民(min)(min)政(zheng)府(fu),各縣(市(shi)、區)人民(min)(min)政(zheng)府(fu),省政(zheng)府(fu)各部(bu)門、各直(zhi)屬(shu)機構:
民(min)(min)辦(ban)教(jiao)育(yu)(yu)(yu)是教(jiao)育(yu)(yu)(yu)事業的重要組成部分,對(dui)促(cu)(cu)進(jin)我(wo)(wo)省教(jiao)育(yu)(yu)(yu)改革發(fa)(fa)展(zhan)發(fa)(fa)揮了重要作(zuo)用,為推(tui)動我(wo)(wo)省經(jing)濟社(she)會發(fa)(fa)展(zhan)作(zuo)出了重要貢獻(xian)。為深(shen)入(ru)學習貫徹習近平總(zong)書記重要講(jiang)話精神,鼓勵社(she)會力量(liang)興辦(ban)教(jiao)育(yu)(yu)(yu),促(cu)(cu)進(jin)民(min)(min)辦(ban)教(jiao)育(yu)(yu)(yu)健康發(fa)(fa)展(zhan),加快建設教(jiao)育(yu)(yu)(yu)強省,根據《中華人民(min)(min)共和國民(min)(min)辦(ban)教(jiao)育(yu)(yu)(yu)促(cu)(cu)進(jin)法》《國務(wu)院(yuan)關于鼓勵社(she)會力量(liang)興辦(ban)教(jiao)育(yu)(yu)(yu)促(cu)(cu)進(jin)民(min)(min)辦(ban)教(jiao)育(yu)(yu)(yu)健康發(fa)(fa)展(zhan)的若干意見》(國發(fa)(fa)〔2016〕81號),結(jie)合(he)我(wo)(wo)省實際,提出如下實施意見。
一、總體要求
全面(mian)貫(guan)徹黨的(de)十九大(da)精神,以習近(jin)平(ping)新(xin)時代中國特色社(she)(she)(she)會(hui)主(zhu)義思想為指導,深(shen)入(ru)貫(guan)徹習近(jin)平(ping)總書記(ji)重要講話(hua)精神,認真落實(shi)黨的(de)教(jiao)育(yu)方針,堅持(chi)(chi)社(she)(she)(she)會(hui)主(zhu)義辦(ban)學(xue)(xue)方向,培育(yu)和踐行(xing)社(she)(she)(she)會(hui)主(zhu)義核心價值(zhi)觀。按照育(yu)人為本、德育(yu)為先,分類(lei)管理(li)、公益導向,優化(hua)環境、綜(zong)合施策,依法(fa)管理(li)、規范(fan)辦(ban)學(xue)(xue),鼓(gu)勵改革、上下聯(lian)動的(de)原則,以實(shi)行(xing)分類(lei)管理(li)為突(tu)破(po)口,創新(xin)體制機制,完善扶持(chi)(chi)政策,加強規范(fan)管理(li),提(ti)高辦(ban)學(xue)(xue)質量,進(jin)一步調動社(she)(she)(she)會(hui)力量興辦(ban)教(jiao)育(yu)的(de)積極性(xing),促進(jin)民(min)辦(ban)教(jiao)育(yu)持(chi)(chi)續健(jian)康發(fa)展(zhan)(zhan),培養(yang)德智體美(mei)全面(mian)發(fa)展(zhan)(zhan)的(de)社(she)(she)(she)會(hui)主(zhu)義建設者和接班人。
二、加(jia)強黨對(dui)民辦學(xue)校的領導
(一(yi))加(jia)(jia)強民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)的(de)建(jian)(jian)(jian)設(she)。全面加(jia)(jia)強民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)的(de)政治建(jian)(jian)(jian)設(she)、思想(xiang)建(jian)(jian)(jian)設(she)、組(zu)(zu)織(zhi)建(jian)(jian)(jian)設(she)、作(zuo)(zuo)風建(jian)(jian)(jian)設(she)、紀律建(jian)(jian)(jian)設(she),把制(zhi)度建(jian)(jian)(jian)設(she)貫(guan)穿其中,推動各(ge)級各(ge)類民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)和(he)(he)黨(dang)(dang)(dang)(dang)(dang)的(de)工(gong)作(zuo)(zuo)全覆(fu)蓋。發揮民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)政治核心作(zuo)(zuo)用(yong)、基層黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)的(de)戰斗堡(bao)壘作(zuo)(zuo)用(yong)和(he)(he)共產黨(dang)(dang)(dang)(dang)(dang)員(yuan)的(de)先鋒模(mo)范帶頭(tou)作(zuo)(zuo)用(yong)。逐步從教育行政部門和(he)(he)公辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)選派黨(dang)(dang)(dang)(dang)(dang)務經驗豐富的(de)在(zai)職干部擔任(ren)民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)書記。加(jia)(jia)強民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)建(jian)(jian)(jian)工(gong)作(zuo)(zuo)機構、隊伍、經費的(de)保(bao)障(zhang)。各(ge)地要(yao)(yao)對民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)建(jian)(jian)(jian)設(she)、黨(dang)(dang)(dang)(dang)(dang)對民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)的(de)領導(dao)(dao)、黨(dang)(dang)(dang)(dang)(dang)組(zu)(zu)織(zhi)開展工(gong)作(zuo)(zuo)等(deng)情況(kuang)定(ding)期開展督導(dao)(dao)檢(jian)查,并作(zuo)(zuo)為民辦學(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)年度檢(jian)查的(de)重要(yao)(yao)內容和(he)(he)評選表彰的(de)重要(yao)(yao)指標。
(二(er))加(jia)強和改進(jin)民辦學校思(si)(si)(si)想(xiang)(xiang)政(zheng)治工(gong)作。把思(si)(si)(si)想(xiang)(xiang)政(zheng)治工(gong)作納入學校事(shi)業發(fa)展(zhan)規劃,把思(si)(si)(si)想(xiang)(xiang)政(zheng)治工(gong)作隊(dui)伍(wu)建(jian)設納入學校人才隊(dui)伍(wu)培養規劃,切(qie)(qie)實加(jia)強思(si)(si)(si)想(xiang)(xiang)政(zheng)治理(li)(li)論(lun)課和德育課課程、教(jiao)(jiao)材、教(jiao)(jiao)師隊(dui)伍(wu)建(jian)設,全面提升思(si)(si)(si)想(xiang)(xiang)政(zheng)治工(gong)作水(shui)平,扎實推進(jin)習近平新時代中(zhong)國(guo)(guo)(guo)(guo)特色社會(hui)主(zhu)(zhu)(zhu)義(yi)(yi)思(si)(si)(si)想(xiang)(xiang)進(jin)教(jiao)(jiao)材、進(jin)課堂、進(jin)頭腦,不斷增強廣大(da)(da)師生中(zhong)國(guo)(guo)(guo)(guo)特色社會(hui)主(zhu)(zhu)(zhu)義(yi)(yi)道路自信(xin)、理(li)(li)論(lun)自信(xin)、制(zhi)(zhi)度自信(xin)、文化自信(xin)。以(yi)社會(hui)主(zhu)(zhu)(zhu)義(yi)(yi)核心價值觀為引(yin)領(ling),切(qie)(qie)實加(jia)強理(li)(li)想(xiang)(xiang)信(xin)念、愛(ai)國(guo)(guo)(guo)(guo)主(zhu)(zhu)(zhu)義(yi)(yi)、集體主(zhu)(zhu)(zhu)義(yi)(yi)、中(zhong)國(guo)(guo)(guo)(guo)特色社會(hui)主(zhu)(zhu)(zhu)義(yi)(yi)教(jiao)(jiao)育和中(zhong)華(hua)優(you)秀傳統文化、革命傳統文化、民族團結(jie)教(jiao)(jiao)育,引(yin)導(dao)學生樹立(li)正確(que)的世界觀、人生觀、價值觀。大(da)(da)力開展(zhan)社會(hui)實踐和志愿服(fu)務,積極開展(zhan)心理(li)(li)健康(kang)教(jiao)(jiao)育。創新網絡思(si)(si)(si)想(xiang)(xiang)政(zheng)治教(jiao)(jiao)育方(fang)式,大(da)(da)力弘(hong)揚主(zhu)(zhu)(zhu)旋律、傳播正能量。落實意(yi)識形態工(gong)作責任制(zhi)(zhi),加(jia)強講座、論(lun)壇等(deng)陣地(di)建(jian)設和管理(li)(li),牢牢把握意(yi)識形態工(gong)作的領(ling)導(dao)權、話語權。
三(san)、實(shi)施(shi)分(fen)類管理
(三)落實(shi)分(fen)類(lei)管理(li)政策。認真(zhen)貫徹實(shi)施《中華(hua)人(ren)民(min)(min)(min)共和(he)國(guo)民(min)(min)(min)辦(ban)(ban)(ban)(ban)教育促(cu)進(jin)法(fa)(fa)》,對全省(sheng)民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校實(shi)行(xing)非營(ying)(ying)利性(xing)(xing)和(he)營(ying)(ying)利性(xing)(xing)分(fen)類(lei)管理(li)。新設(she)民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校,應明(ming)確按非營(ying)(ying)利性(xing)(xing)或營(ying)(ying)利性(xing)(xing)分(fen)類(lei)審批(pi)和(he)登記(ji)。2016年(nian)11月7日《全國(guo)人(ren)民(min)(min)(min)代表(biao)大會(hui)常務委員會(hui)關于(yu)修改〈中華(hua)人(ren)民(min)(min)(min)共和(he)國(guo)民(min)(min)(min)辦(ban)(ban)(ban)(ban)教育促(cu)進(jin)法(fa)(fa)〉的決定(ding)》公布(bu)前經(jing)批(pi)準設(she)立的民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校(以下稱(cheng)現(xian)有民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校),應根據(ju)省(sheng)的工(gong)作部(bu)署并結合當(dang)地(di)實(shi)際開展分(fen)類(lei)登記(ji)。教育、人(ren)力資源社會(hui)保障、民(min)(min)(min)政、編制(zhi)、工(gong)商等部(bu)門要(yao)抓緊完善民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校分(fen)類(lei)登記(ji)制(zhi)度,細化登記(ji)事(shi)項及流程,明(ming)確民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)校變更登記(ji)類(lei)型的辦(ban)(ban)(ban)(ban)法(fa)(fa)和(he)工(gong)作規程。
(四)建立平穩過(guo)渡機制。各(ge)地(di)、各(ge)有(you)關單(dan)位要認真指(zhi)導現有(you)民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)開(kai)展財(cai)務(wu)清(qing)查(cha)、清(qing)算(suan)(suan)和章程修訂工(gong)作,按“一(yi)校(xiao)(xiao)一(yi)策(ce)”原則(ze)制定過(guo)渡工(gong)作方案(an),平穩有(you)序推(tui)進分(fen)類管理。現有(you)民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)以2017年8月(yue)31日為基(ji)準(zhun)日,在完(wan)成(cheng)財(cai)務(wu)清(qing)查(cha)或清(qing)算(suan)(suan)及修改學(xue)(xue)(xue)校(xiao)(xiao)章程后,按照教(jiao)育部(bu)《民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)分(fen)類登(deng)記實施細則(ze)》(教(jiao)發〔2016〕19號)以及省的(de)(de)相(xiang)關規定進行分(fen)類登(deng)記;其中,選擇登(deng)記為營(ying)利(li)性(xing)學(xue)(xue)(xue)校(xiao)(xiao)的(de)(de),應(ying)在完(wan)成(cheng)明確財(cai)產權屬、完(wan)善用地(di)手(shou)續(xu)、繳納(na)相(xiang)關稅費、換發辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)許可(ke)證、辦(ban)(ban)(ban)(ban)理民(min)(min)(min)辦(ban)(ban)(ban)(ban)非(fei)企業單(dan)位或事業單(dan)位注銷手(shou)續(xu)等工(gong)作后,到工(gong)商部(bu)門登(deng)記。含(han)有(you)義(yi)務(wu)教(jiao)育階段多層次辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)的(de)(de)現有(you)民(min)(min)(min)辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao),非(fei)義(yi)務(wu)教(jiao)育階段選擇營(ying)利(li)性(xing)辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)的(de)(de),應(ying)在財(cai)務(wu)清(qing)算(suan)(suan)后進行資(zi)產剝離,并(bing)換發辦(ban)(ban)(ban)(ban)學(xue)(xue)(xue)許可(ke)證后,到相(xiang)應(ying)的(de)(de)登(deng)記機關登(deng)記。
(五)健全(quan)退出(chu)機制(zhi)。捐(juan)資舉辦(ban)(ban)(ban)的(de)(de)民(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)終(zhong)止(zhi)(zhi)時(shi),清償后(hou)的(de)(de)剩余財(cai)(cai)產統(tong)籌用(yong)于教育等事業。現(xian)有(you)民(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)選(xuan)(xuan)擇登記為非營(ying)利性民(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)的(de)(de),終(zhong)止(zhi)(zhi)時(shi),學(xue)(xue)校(xiao)財(cai)(cai)產依法清償后(hou)有(you)剩余的(de)(de),應根據出(chu)資者申請,綜合考(kao)慮2017年8月31日前(qian)的(de)(de)出(chu)資、取得合理(li)回報情況以及辦(ban)(ban)(ban)學(xue)(xue)效益、繼(ji)續辦(ban)(ban)(ban)學(xue)(xue)時(shi)間長短等因(yin)素,按(an)(an)“一校(xiao)一策”原則對出(chu)資者進行補償或獎勵(li),其余財(cai)(cai)產繼(ji)續用(yong)于其他非營(ying)利性學(xue)(xue)校(xiao)辦(ban)(ban)(ban)學(xue)(xue),具(ju)體(ti)補償或獎勵(li)辦(ban)(ban)(ban)法由各級教育、人力資源社會保障部門按(an)(an)照審批權(quan)限另(ling)行制(zhi)定;選(xuan)(xuan)擇登記為營(ying)利性民(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)的(de)(de),終(zhong)止(zhi)(zhi)時(shi),學(xue)(xue)校(xiao)財(cai)(cai)產依法清償后(hou)有(you)剩余的(de)(de),依照《中(zhong)華人民(min)共和國(guo)公司法》的(de)(de)有(you)關規定處(chu)(chu)理(li)。2016年11月7日后(hou)設立的(de)(de)民(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao),終(zhong)止(zhi)(zhi)時(shi),財(cai)(cai)產處(chu)(chu)置按(an)(an)照有(you)關規定和學(xue)(xue)校(xiao)章程處(chu)(chu)理(li)。
四、創新(xin)辦學體(ti)制(zhi)
(六)放寬辦(ban)(ban)學(xue)(xue)準入條件(jian)。社(she)會(hui)(hui)力量投入教(jiao)育,凡(fan)法律法規(gui)沒有(you)禁止(zhi)(zhi)以及不損害第三方利益、社(she)會(hui)(hui)公(gong)共利益、國(guo)家(jia)安全的領(ling)域(yu),一律不得(de)進行限制。各地要(yao)制定(ding)準入負面清(qing)單,列出(chu)禁止(zhi)(zhi)和(he)限制的辦(ban)(ban)學(xue)(xue)行為。各地、各有(you)關(guan)單位要(yao)做好(hao)民(min)辦(ban)(ban)教(jiao)育發展規(gui)劃,重新梳理民(min)辦(ban)(ban)學(xue)(xue)校(xiao)準入條件(jian)和(he)程序,進一步簡政放權,吸引(yin)更多的社(she)會(hui)(hui)資源進入教(jiao)育領(ling)域(yu),并優(you)先支持社(she)會(hui)(hui)力量舉辦(ban)(ban)民(min)辦(ban)(ban)義務教(jiao)育學(xue)(xue)校(xiao)和(he)普惠(hui)性民(min)辦(ban)(ban)幼兒園,增加學(xue)(xue)位供給。
(七)探索(suo)多元主體合作辦學。各地可(ke)探索(suo)依法利用國(guo)有(you)(you)(you)資產(chan)、集(ji)體資產(chan)、非(fei)公(gong)有(you)(you)(you)資產(chan)等,通過合資、合作、參股、租賃等方(fang)(fang)式與(yu)社(she)會(hui)力(li)量(liang)聯合辦學。支持(chi)社(she)會(hui)力(li)量(liang)以(yi)協議托管等形式,在不改變所有(you)(you)(you)制并明確各方(fang)(fang)責(ze)權(quan)利前提下,參與(yu)公(gong)辦學校(xiao)辦學。支持(chi)國(guo)有(you)(you)(you)資產(chan)依法參與(yu)舉(ju)辦非(fei)營利性民辦學校(xiao),鼓勵以(yi)國(guo)有(you)(you)(you)建(jian)設(she)用地使用權(quan)作價出資或者入股等方(fang)(fang)式提供土地依法與(yu)社(she)會(hui)資本共同(tong)舉(ju)辦民辦學校(xiao)。國(guo)有(you)(you)(you)資產(chan)監管機(ji)構要對民辦學校(xiao)中的國(guo)有(you)(you)(you)資產(chan)加強監管,防止國(guo)有(you)(you)(you)資產(chan)流失。
(八)拓寬辦(ban)學籌融(rong)資渠道。鼓勵和吸引社(she)會(hui)資金(jin)進入(ru)教育領(ling)域舉辦(ban)學校或投入(ru)項目建(jian)設(she)。鼓勵各類社(she)會(hui)組織和個人對非(fei)營利(li)性民辦(ban)學校給予捐(juan)贈。鼓勵民辦(ban)學校設(she)立學校發展基金(jin)。探索辦(ban)理民辦(ban)學校未來經營收(shou)入(ru)、知識產權(quan)質押貸款業務(wu)(wu),提供銀行貸款、信(xin)托等(deng)多樣化(hua)金(jin)融(rong)服務(wu)(wu)。允許營利(li)性民辦(ban)學校探索利(li)用多層次資本市場開(kai)展股權(quan)融(rong)資。
五、加大政策支持
(九)加(jia)大財(cai)政投入(ru)(ru)力度。各(ge)地(di)級以上市(shi)、縣(xian)(市(shi)、區)政府要(yao)按照《中(zhong)(zhong)華人(ren)民共和(he)國預算法(fa)(fa)》《中(zhong)(zhong)華人(ren)民共和(he)國教(jiao)育(yu)法(fa)(fa)》《中(zhong)(zhong)華人(ren)民共和(he)國民辦教(jiao)育(yu)促(cu)進法(fa)(fa)》等(deng)法(fa)(fa)律法(fa)(fa)規(gui)規(gui)定,因地(di)制宜(yi),調整優化(hua)教(jiao)育(yu)支出結構,不斷加(jia)大對(dui)民辦教(jiao)育(yu)的(de)(de)扶持力度。縣(xian)級以上政府要(yao)設(she)立民辦教(jiao)育(yu)發(fa)(fa)展專項資金(jin),資助民辦教(jiao)育(yu)發(fa)(fa)展。各(ge)級財(cai)政扶持民辦教(jiao)育(yu)發(fa)(fa)展的(de)(de)資金(jin)要(yao)納入(ru)(ru)預算,并向社(she)會公(gong)開,接受審計和(he)社(she)會監督,提高資金(jin)使(shi)用效益。
(十(shi))健全政(zheng)(zheng)府(fu)扶持獎勵(li)機制。各(ge)地(di)級以上市(shi)、縣(市(shi)、區)政(zheng)(zheng)府(fu)要(yao)建立(li)健全政(zheng)(zheng)府(fu)補(bu)貼制度,創新財政(zheng)(zheng)補(bu)貼方式,探索對民(min)辦學校(xiao)給予(yu)經(jing)費(fei)獎補(bu),明確補(bu)貼的項(xiang)目、對象、標(biao)(biao)準(zhun)、用途(tu);要(yao)按不(bu)低于公辦義(yi)務教育學校(xiao)生均(jun)公用經(jing)費(fei)的標(biao)(biao)準(zhun)補(bu)助民(min)辦義(yi)務教育學校(xiao),對按規定(ding)可繼續向(xiang)學生收取學費(fei)的,須扣除(chu)公用經(jing)費(fei)補(bu)助標(biao)(biao)準(zhun)部分;完善政(zheng)(zheng)府(fu)購買(mai)服務的標(biao)(biao)準(zhun)和程序,制定(ding)向(xiang)民(min)辦學校(xiao)購買(mai)學位、課程教材、科研成果(guo)、職業(ye)培訓、政(zheng)(zheng)策(ce)咨詢(xun)等教育服務的具體辦法,建立(li)績(ji)效評價制度。鼓勵(li)各(ge)地(di)加大對普惠性民(min)辦幼兒園的扶持力度。

(十二)落實稅(shui)(shui)(shui)(shui)費優惠(hui)(hui)(hui)激勵政(zheng)策。非營(ying)利性民(min)辦學(xue)校(xiao)享受與公(gong)(gong)辦學(xue)校(xiao)同等(deng)的(de)稅(shui)(shui)(shui)(shui)收(shou)(shou)優惠(hui)(hui)(hui)政(zheng)策,營(ying)利性民(min)辦學(xue)校(xiao)享受國(guo)家規定的(de)稅(shui)(shui)(shui)(shui)收(shou)(shou)優惠(hui)(hui)(hui)政(zheng)策。對企業(ye)支(zhi)持教(jiao)育(yu)(yu)事(shi)業(ye)的(de)公(gong)(gong)益性捐(juan)贈支(zhi)出,按(an)(an)照稅(shui)(shui)(shui)(shui)法有(you)關規定,在(zai)(zai)年(nian)度利潤(run)(run)總額12%以(yi)內的(de)部分,準予在(zai)(zai)計算應(ying)納(na)稅(shui)(shui)(shui)(shui)所(suo)得(de)額時扣除(chu)(chu)。超過年(nian)度利潤(run)(run)總額12%的(de)部分,準予結(jie)轉以(yi)后三年(nian)內在(zai)(zai)計算應(ying)納(na)稅(shui)(shui)(shui)(shui)所(suo)得(de)額時扣除(chu)(chu)。個人將其所(suo)得(de)通過中國(guo)境內的(de)公(gong)(gong)益性社(she)會組織、縣(xian)級以(yi)上政(zheng)府及其組成(cheng)部門和直屬機構向教(jiao)育(yu)(yu)事(shi)業(ye)的(de)捐(juan)贈,按(an)(an)規定在(zai)(zai)個人所(suo)得(de)稅(shui)(shui)(shui)(shui)應(ying)納(na)稅(shui)(shui)(shui)(shui)所(suo)得(de)額中全額扣除(chu)(chu)。對民(min)辦學(xue)校(xiao)自(zi)用的(de)房產(chan)、土地(di),免(mian)征房產(chan)稅(shui)(shui)(shui)(shui)、城(cheng)鎮土地(di)使用稅(shui)(shui)(shui)(shui)。
(十三)實行分類收(shou)(shou)費(fei)(fei)政策。按(an)照市(shi)場化改(gai)革(ge)方(fang)向擴大(da)民辦學(xue)校(xiao)收(shou)(shou)費(fei)(fei)自主權。義務(wu)教育(yu)階段民辦學(xue)校(xiao)的收(shou)(shou)費(fei)(fei),原則上實行政府定價(jia),視相關改(gai)革(ge)進程及市(shi)場競爭程度適(shi)時放開;其余各(ge)級各(ge)類民辦學(xue)校(xiao)收(shou)(shou)費(fei)(fei)實行市(shi)場調(diao)節價(jia)。民辦學(xue)校(xiao)可以按(an)學(xue)期或學(xue)年收(shou)(shou)費(fei)(fei),收(shou)(shou)費(fei)(fei)項目、標準和方(fang)式應在招生(sheng)報名(ming)開始前不少于30天向社會公示,不得在公示項目和標準之外收(shou)(shou)取其他費(fei)(fei)用。
六、健全管理制度
(十(shi)四(si))完善(shan)學(xue)校(xiao)法(fa)人治(zhi)理。完善(shan)民辦(ban)學(xue)校(xiao)章(zhang)程(cheng)管理,切(qie)實發揮章(zhang)程(cheng)在辦(ban)學(xue)治(zhi)校(xiao)中(zhong)的(de)(de)作用。健全(quan)董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui))、監(jian)事(shi)(shi)(會(hui)(hui)(hui)(hui))制(zhi)度(du),依法(fa)落實董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui))、監(jian)事(shi)(shi)(會(hui)(hui)(hui)(hui))職權,保障董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui))和(he)監(jian)事(shi)(shi)會(hui)(hui)(hui)(hui)成(cheng)(cheng)員(yuan)依法(fa)按(an)章(zhang)參與(yu)辦(ban)學(xue)和(he)管理。監(jian)事(shi)(shi)會(hui)(hui)(hui)(hui)中(zhong)應當(dang)有黨(dang)(dang)(dang)組(zu)(zu)織領導(dao)(dao)班(ban)(ban)子(zi)成(cheng)(cheng)員(yuan)。學(xue)校(xiao)的(de)(de)決(jue)(jue)策(ce)、行(xing)政、監(jian)督機(ji)構成(cheng)(cheng)員(yuan)和(he)人事(shi)(shi)、財務(wu)等(deng)關鍵管理崗位應當(dang)實行(xing)親屬(shu)回(hui)避制(zhi)度(du)。積(ji)極推進(jin)“雙向進(jin)入、交叉任職”,學(xue)校(xiao)黨(dang)(dang)(dang)組(zu)(zu)織領導(dao)(dao)班(ban)(ban)子(zi)成(cheng)(cheng)員(yuan)通過法(fa)定程(cheng)序進(jin)入學(xue)校(xiao)決(jue)(jue)策(ce)機(ji)構和(he)行(xing)政管理機(ji)構,黨(dang)(dang)(dang)員(yuan)校(xiao)長(chang)、副(fu)校(xiao)長(chang)等(deng)行(xing)政班(ban)(ban)子(zi)成(cheng)(cheng)員(yuan)可(ke)按(an)照有關規定進(jin)入黨(dang)(dang)(dang)組(zu)(zu)織領導(dao)(dao)班(ban)(ban)子(zi),黨(dang)(dang)(dang)委書記應通過法(fa)定程(cheng)序進(jin)入學(xue)校(xiao)董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui)),并兼(jian)任行(xing)政領導(dao)(dao)班(ban)(ban)子(zi)成(cheng)(cheng)員(yuan)。學(xue)校(xiao)黨(dang)(dang)(dang)組(zu)(zu)織要(yao)參與(yu)重大問(wen)題決(jue)(jue)策(ce),并與(yu)學(xue)校(xiao)董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui))和(he)監(jian)事(shi)(shi)(會(hui)(hui)(hui)(hui))建(jian)(jian)立(li)溝通協(xie)商(shang)、與(yu)行(xing)政領導(dao)(dao)班(ban)(ban)子(zi)建(jian)(jian)立(li)聯席會(hui)(hui)(hui)(hui)議等(deng)制(zhi)度(du)。落實教職工代表進(jin)入董事(shi)(shi)會(hui)(hui)(hui)(hui)(理事(shi)(shi)會(hui)(hui)(hui)(hui))、監(jian)事(shi)(shi)(會(hui)(hui)(hui)(hui))的(de)(de)規定,保障教職工參與(yu)民主管理和(he)監(jian)督的(de)(de)權利。
(十五)保障受教(jiao)(jiao)育(yu)(yu)者權(quan)益(yi)。依法保障學(xue)(xue)生(sheng)的受教(jiao)(jiao)育(yu)(yu)權(quan)、教(jiao)(jiao)育(yu)(yu)選擇權(quan)以及(ji)對學(xue)(xue)校(xiao)辦學(xue)(xue)管理的知情權(quan)、參與(yu)權(quan)。民(min)辦學(xue)(xue)校(xiao)的受教(jiao)(jiao)育(yu)(yu)者在升(sheng)學(xue)(xue)、就業、社(she)會(hui)優待(dai)、接(jie)受資助以及(ji)評選表彰等方面(mian)享有(you)同(tong)級同(tong)類公辦學(xue)(xue)校(xiao)受教(jiao)(jiao)育(yu)(yu)者的同(tong)等權(quan)利。民(min)辦學(xue)(xue)校(xiao)應落實從學(xue)(xue)費收入(ru)中提取(qu)不少于5%的資金(jin)用于獎(jiang)(jiang)勵(li)和(he)資助學(xue)(xue)生(sheng)的規定。鼓(gu)勵(li)企事業單位(wei)、社(she)會(hui)組織和(he)個人(ren)面(mian)向(xiang)民(min)辦學(xue)(xue)校(xiao)設立獎(jiang)(jiang)助學(xue)(xue)金(jin)。
(十六)保(bao)障教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)權益。依(yi)法保(bao)障和落實民(min)(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)(jiao)師(shi)職(zhi)稱(cheng)評(ping)定(ding)、科研(yan)立(li)項等(deng)方面享(xiang)有(you)與公(gong)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)(jiao)師(shi)同(tong)等(deng)權利。建立(li)健全政府、學(xue)(xue)校(xiao)、個人(ren)合理分擔的(de)(de)民(min)(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)社會(hui)保(bao)障機制,保(bao)障教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)的(de)(de)社會(hui)保(bao)險(xian)(xian)待(dai)遇。民(min)(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)應(ying)當與教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)簽訂合同(tong),按時足(zu)額發放教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)的(de)(de)薪酬,依(yi)法繳納社會(hui)保(bao)險(xian)(xian)費和足(zu)額繳存(cun)住房公(gong)積金(jin)。支持有(you)條件的(de)(de)地區發放民(min)(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)(jiao)師(shi)從教(jiao)(jiao)(jiao)津(jin)貼。鼓勵民(min)(min)辦(ban)(ban)(ban)學(xue)(xue)校(xiao)為教(jiao)(jiao)(jiao)職(zhi)工(gong)(gong)建立(li)年(nian)金(jin)等(deng)補(bu)充養(yang)老(lao)保(bao)險(xian)(xian),提高教(jiao)(jiao)(jiao)師(shi)退休待(dai)遇。
(十七)保(bao)障(zhang)舉(ju)(ju)辦者(zhe)(zhe)權(quan)益。保(bao)障(zhang)民辦學校(xiao)的舉(ju)(ju)辦者(zhe)(zhe)或其代表依(yi)照政策(ce)法(fa)規和學校(xiao)章(zhang)程(cheng)規定的權(quan)限(xian)及程(cheng)序參與辦學和管(guan)理。保(bao)障(zhang)舉(ju)(ju)辦者(zhe)(zhe)依(yi)法(fa)按章(zhang)選擇(ze)登記(ji)類型、日(ri)常運營管(guan)理、重(zhong)大事(shi)項變更(geng)、獲取勞動報(bao)酬、獲得補償或獎勵等權(quan)利。
(十八(ba))健全資(zi)產(chan)財務(wu)管理制(zhi)(zhi)度。民辦(ban)學(xue)校(xiao)(xiao)(xiao)(xiao)應落實年(nian)度預算(suan)、決算(suan)報告報備制(zhi)(zhi)度,將(jiang)舉辦(ban)者出(chu)(chu)資(zi)、政府補助(zhu)、收費(fei)、受(shou)贈、辦(ban)學(xue)積累等各類(lei)資(zi)產(chan)分(fen)類(lei)登(deng)記入賬,每個會計年(nian)度開展資(zi)產(chan)清查(cha),并(bing)將(jiang)清查(cha)結果向社會公布。建立健全民辦(ban)學(xue)校(xiao)(xiao)(xiao)(xiao)第三方審(shen)計制(zhi)(zhi)度、信息公開制(zhi)(zhi)度和(he)違規失信懲(cheng)戒機制(zhi)(zhi)。民辦(ban)學(xue)校(xiao)(xiao)(xiao)(xiao)收取的費(fei)用應當主要用于教育教學(xue)活動、改(gai)善(shan)辦(ban)學(xue)條件和(he)保障教職工待遇;應當全部納入學(xue)校(xiao)(xiao)(xiao)(xiao)財務(wu)專戶(hu),并(bing)按照有關規定(ding)向受(shou)教育者出(chu)(chu)具相應票據。
(十九)完善(shan)風險防(fang)范(fan)機(ji)制(zhi)(zhi)。各(ge)地(di)級以上(shang)市、縣(市、區)政府(fu)及民辦學校(xiao)(xiao)要(yao)建(jian)立完善(shan)風險防(fang)范(fan)和(he)應急(ji)處置機(ji)制(zhi)(zhi),制(zhi)(zhi)定(ding)預(yu)案(an),重點(dian)防(fang)范(fan)和(he)化(hua)(hua)解因經(jing)營管(guan)理(li)不善(shan)、重大變更及終(zhong)止辦學引發(fa)的(de)風險。探索(suo)建(jian)立民辦學校(xiao)(xiao)聯(lian)合(he)保險制(zhi)(zhi)度。各(ge)地(di)和(he)各(ge)民辦學校(xiao)(xiao)要(yao)落實安(an)(an)全管(guan)理(li)責(ze)任(ren)(ren)(ren)和(he)安(an)(an)全工作專項經(jing)費,按照(zhao)有關規(gui)定(ding)購買校(xiao)(xiao)方責(ze)任(ren)(ren)(ren)、校(xiao)(xiao)車承運(yun)人責(ze)任(ren)(ren)(ren)等保險。民辦學校(xiao)(xiao)的(de)法定(ding)代表人要(yao)履行學校(xiao)(xiao)安(an)(an)全管(guan)理(li)和(he)穩(wen)(wen)定(ding)工作第一責(ze)任(ren)(ren)(ren)人的(de)職責(ze),組(zu)織(zhi)落實好人防(fang)、物防(fang)、技防(fang)建(jian)設(she)和(he)矛盾糾紛排查化(hua)(hua)解等工作,確保校(xiao)(xiao)園安(an)(an)全穩(wen)(wen)定(ding)。
七、提高教育質量
(二十)提升教(jiao)(jiao)師(shi)(shi)隊(dui)伍水平。教(jiao)(jiao)育、人(ren)力(li)資源(yuan)社會保障(zhang)部門要(yao)將民辦(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)師(shi)(shi)與公(gong)辦(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)師(shi)(shi)納(na)入同(tong)系列、同(tong)要(yao)求、同(tong)待(dai)遇的(de)師(shi)(shi)資培訓計劃,民辦(ban)學(xue)(xue)校(xiao)要(yao)在經費和時間上予以保障(zhang)。民辦(ban)學(xue)(xue)校(xiao)要(yao)重視中青年(nian)教(jiao)(jiao)師(shi)(shi)隊(dui)伍建設(she),加大對教(jiao)(jiao)育教(jiao)(jiao)學(xue)(xue)研究的(de)支持(chi)力(li)度。支持(chi)符合條(tiao)件的(de)高層(ceng)次人(ren)才到(dao)民辦(ban)學(xue)(xue)校(xiao)任教(jiao)(jiao)。完善公(gong)辦(ban)、民辦(ban)學(xue)(xue)校(xiao)教(jiao)(jiao)師(shi)(shi)合理(li)流動機制,鼓勵公(gong)辦(ban)學(xue)(xue)校(xiao)選派優秀教(jiao)(jiao)師(shi)(shi)到(dao)有需要(yao)的(de)民辦(ban)學(xue)(xue)校(xiao)幫教(jiao)(jiao)扶教(jiao)(jiao)。
(二十一)提高人才培(pei)(pei)養(yang)質(zhi)量。積(ji)極引(yin)導民(min)辦(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)服(fu)務社會需求,明(ming)確發(fa)展定位,創(chuang)新辦(ban)(ban)(ban)學(xue)(xue)(xue)模式(shi),分(fen)類(lei)分(fen)層發(fa)展。支持民(min)辦(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)更新辦(ban)(ban)(ban)學(xue)(xue)(xue)理念(nian),深(shen)化(hua)教育(yu)(yu)教學(xue)(xue)(xue)改革,加強(qiang)內涵建(jian)設,培(pei)(pei)育(yu)(yu)學(xue)(xue)(xue)校(xiao)(xiao)特色,提高辦(ban)(ban)(ban)學(xue)(xue)(xue)質(zhi)量。從事學(xue)(xue)(xue)歷(li)教育(yu)(yu)的民(min)辦(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao),應當建(jian)立(li)教育(yu)(yu)教學(xue)(xue)(xue)質(zhi)量保障體系,按(an)照國家課程(cheng)標(biao)準和(he)學(xue)(xue)(xue)校(xiao)(xiao)人才培(pei)(pei)養(yang)方(fang)案,開(kai)齊開(kai)足課程(cheng),不(bu)得(de)隨意增(zeng)減課程(cheng)、課時和(he)學(xue)(xue)(xue)分(fen)。支持民(min)辦(ban)(ban)(ban)高等學(xue)(xue)(xue)校(xiao)(xiao)參加專業認(ren)證(zheng)(zheng)和(he)國際認(ren)證(zheng)(zheng)。推(tui)進管辦(ban)(ban)(ban)評分(fen)離(li),建(jian)立(li)民(min)辦(ban)(ban)(ban)學(xue)(xue)(xue)校(xiao)(xiao)第三(san)方(fang)質(zhi)量認(ren)證(zheng)(zheng)和(he)評估制度,實(shi)現人才培(pei)(pei)養(yang)質(zhi)量的常態監(jian)測與定期評估有機結合,推(tui)動人才培(pei)(pei)養(yang)質(zhi)量不(bu)斷提升(sheng)。
八、提升管理(li)服務水平
(二(er)十二(er))強(qiang)化部(bu)門(men)協(xie)調(diao)。建(jian)(jian)立由省(sheng)教育廳(ting)牽頭,省(sheng)編辦(ban)(ban)、發展改(gai)革委、公(gong)安(an)廳(ting)、民(min)政(zheng)(zheng)廳(ting)、財政(zheng)(zheng)廳(ting)、人(ren)(ren)力資(zi)源(yuan)(yuan)社會保障廳(ting)、國土資(zi)源(yuan)(yuan)廳(ting)、住房(fang)城鄉建(jian)(jian)設廳(ting)、審計廳(ting)、國資(zi)委、地稅局(ju)、工(gong)商局(ju)、金融辦(ban)(ban)和省(sheng)國稅局(ju)、人(ren)(ren)民(min)銀行廣(guang)州(zhou)分行、廣(guang)東銀監局(ju)、廣(guang)東證監局(ju)、廣(guang)東保監局(ju)等部(bu)門(men)參加的(de)部(bu)門(men)間工(gong)作聯席(xi)會議制(zhi)(zhi)度,協(xie)調(diao)解決(jue)民(min)辦(ban)(ban)教育發展中遇到(dao)的(de)困難和問題。各地要(yao)參照省(sheng)的(de)做法建(jian)(jian)立相應(ying)的(de)工(gong)作機制(zhi)(zhi)。把(ba)鼓(gu)勵支持社會力量興辦(ban)(ban)教育情況,作為各地級以(yi)上市、縣(xian)(市、區(qu))政(zheng)(zheng)府(fu)改(gai)進公(gong)共服(fu)務(wu)方式考核和履行教育職責評價的(de)重要(yao)內容(rong)。
(二(er)十三)加(jia)強(qiang)管理(li)(li)服(fu)(fu)務(wu)。加(jia)強(qiang)民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)管理(li)(li)機構建設,減少民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)的(de)(de)事(shi)前(qian)審批,加(jia)強(qiang)事(shi)中(zhong)事(shi)后(hou)監(jian)(jian)管,加(jia)強(qiang)各監(jian)(jian)管部門之間的(de)(de)協(xie)同(tong)配(pei)合,提高監(jian)(jian)管能力和(he)服(fu)(fu)務(wu)水平(ping)。建立民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)管理(li)(li)信息系(xi)統(tong),推(tui)動(dong)管理(li)(li)事(shi)項網上并聯(lian)辦(ban)(ban)(ban)(ban)理(li)(li),提高服(fu)(fu)務(wu)效(xiao)率。認真落實《中(zhong)華人民(min)共和(he)國民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)促(cu)進(jin)法》有關對民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)發(fa)展做出突出貢獻(xian)的(de)(de)集(ji)體和(he)個人開展表彰獎勵的(de)(de)規(gui)定(ding)。積極發(fa)揮各級民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)協(xie)會等(deng)行(xing)業組(zu)織在承接政(zheng)府購買服(fu)(fu)務(wu)、促(cu)進(jin)行(xing)業自律(lv)、推(tui)動(dong)交流合作(zuo)等(deng)方面的(de)(de)重要作(zuo)用(yong)。做好民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)涉外(wai)(wai)活動(dong)的(de)(de)管理(li)(li)與服(fu)(fu)務(wu)。民(min)辦(ban)(ban)(ban)(ban)高校(xiao)的(de)(de)涉外(wai)(wai)論壇講座、外(wai)(wai)籍(ji)教(jiao)(jiao)師聘任、引進(jin)教(jiao)(jiao)材(cai)選用(yong)等(deng),要嚴格執行(xing)涉外(wai)(wai)管理(li)(li)的(de)(de)有關規(gui)定(ding)。支持民(min)辦(ban)(ban)(ban)(ban)教(jiao)(jiao)育(yu)研(yan)(yan)(yan)究(jiu)平(ping)臺和(he)高水平(ping)研(yan)(yan)(yan)究(jiu)團隊建設,推(tui)動(dong)研(yan)(yan)(yan)究(jiu)成(cheng)果轉化應用(yong)。
