各(ge)地(di)級(ji)以上市人民政府,各(ge)縣(市、區)人民政府,省政府各(ge)部(bu)門、各(ge)直屬機構:
民辦(ban)教(jiao)育(yu)(yu)是教(jiao)育(yu)(yu)事業的重(zhong)(zhong)要(yao)組(zu)成部(bu)分(fen),對促(cu)進我省(sheng)教(jiao)育(yu)(yu)改革發(fa)(fa)展發(fa)(fa)揮(hui)了重(zhong)(zhong)要(yao)作(zuo)用,為推動(dong)我省(sheng)經濟社(she)(she)會(hui)發(fa)(fa)展作(zuo)出(chu)了重(zhong)(zhong)要(yao)貢獻。為深入(ru)學習貫徹習近平總書記重(zhong)(zhong)要(yao)講話精神(shen),鼓(gu)(gu)勵(li)(li)社(she)(she)會(hui)力(li)量(liang)(liang)興辦(ban)教(jiao)育(yu)(yu),促(cu)進民辦(ban)教(jiao)育(yu)(yu)健(jian)康(kang)發(fa)(fa)展,加(jia)快(kuai)建設(she)教(jiao)育(yu)(yu)強省(sheng),根據(ju)《中華人(ren)民共和(he)國民辦(ban)教(jiao)育(yu)(yu)促(cu)進法》《國務院(yuan)關(guan)于鼓(gu)(gu)勵(li)(li)社(she)(she)會(hui)力(li)量(liang)(liang)興辦(ban)教(jiao)育(yu)(yu)促(cu)進民辦(ban)教(jiao)育(yu)(yu)健(jian)康(kang)發(fa)(fa)展的若干(gan)意(yi)(yi)見》(國發(fa)(fa)〔2016〕81號),結合我省(sheng)實(shi)際,提出(chu)如下(xia)實(shi)施意(yi)(yi)見。
一、總體要求
全(quan)面(mian)貫(guan)(guan)徹(che)黨的(de)十九大精神(shen),以習(xi)近(jin)平(ping)新(xin)時代中國(guo)特色社會(hui)(hui)主(zhu)義(yi)思想(xiang)為指(zhi)導(dao),深入貫(guan)(guan)徹(che)習(xi)近(jin)平(ping)總書(shu)記重要講話(hua)精神(shen),認真(zhen)落實黨的(de)教(jiao)育方針,堅持(chi)(chi)社會(hui)(hui)主(zhu)義(yi)辦(ban)學方向,培育和踐行社會(hui)(hui)主(zhu)義(yi)核心價值觀。按照育人為本(ben)、德育為先,分(fen)(fen)類管理(li)、公益導(dao)向,優化環境、綜合施策,依法管理(li)、規(gui)范(fan)(fan)辦(ban)學,鼓勵改革、上(shang)下聯動的(de)原則,以實行分(fen)(fen)類管理(li)為突破口,創新(xin)體制機制,完(wan)善扶持(chi)(chi)政策,加強(qiang)規(gui)范(fan)(fan)管理(li),提高(gao)辦(ban)學質量,進(jin)一步(bu)調動社會(hui)(hui)力(li)量興辦(ban)教(jiao)育的(de)積(ji)極性,促進(jin)民辦(ban)教(jiao)育持(chi)(chi)續健康(kang)發展,培養德智體美全(quan)面(mian)發展的(de)社會(hui)(hui)主(zhu)義(yi)建設(she)者和接班人。
二、加強黨對民(min)辦學校的領導
(一(yi))加強(qiang)民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)的建(jian)(jian)設(she)(she)。全面加強(qiang)民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)的政治建(jian)(jian)設(she)(she)、思想建(jian)(jian)設(she)(she)、組(zu)(zu)織(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)、作風建(jian)(jian)設(she)(she)、紀律(lv)建(jian)(jian)設(she)(she),把制度建(jian)(jian)設(she)(she)貫穿其(qi)中(zhong),推(tui)動各(ge)(ge)級(ji)各(ge)(ge)類民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)和(he)(he)黨(dang)(dang)(dang)的工作全覆蓋。發揮民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)政治核心作用、基層黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)的戰(zhan)斗堡壘作用和(he)(he)共(gong)產黨(dang)(dang)(dang)員的先(xian)鋒模范帶頭作用。逐步從教育行(xing)政部門(men)和(he)(he)公辦(ban)(ban)學(xue)校選派(pai)黨(dang)(dang)(dang)務經驗豐(feng)富的在職干部擔任(ren)民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)書記。加強(qiang)民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)建(jian)(jian)工作機構、隊伍(wu)、經費的保障。各(ge)(ge)地要(yao)(yao)對民辦(ban)(ban)學(xue)校黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)、黨(dang)(dang)(dang)對民辦(ban)(ban)學(xue)校的領導、黨(dang)(dang)(dang)組(zu)(zu)織(zhi)(zhi)(zhi)開展(zhan)工作等情況(kuang)定期開展(zhan)督導檢查(cha),并作為民辦(ban)(ban)學(xue)校年(nian)度檢查(cha)的重要(yao)(yao)內容(rong)和(he)(he)評(ping)選表彰(zhang)的重要(yao)(yao)指標(biao)。
(二(er))加強(qiang)和(he)改進(jin)(jin)民辦學(xue)(xue)校(xiao)思想(xiang)政治工(gong)(gong)作(zuo)。把(ba)思想(xiang)政治工(gong)(gong)作(zuo)納入學(xue)(xue)校(xiao)事(shi)業(ye)發展規劃(hua),把(ba)思想(xiang)政治工(gong)(gong)作(zuo)隊伍建(jian)設納入學(xue)(xue)校(xiao)人(ren)才隊伍培養規劃(hua),切實(shi)加強(qiang)思想(xiang)政治理(li)論(lun)課(ke)和(he)德育課(ke)課(ke)程、教(jiao)(jiao)材(cai)、教(jiao)(jiao)師隊伍建(jian)設,全面(mian)提升思想(xiang)政治工(gong)(gong)作(zuo)水平(ping),扎實(shi)推進(jin)(jin)習近平(ping)新(xin)時代中(zhong)國特(te)(te)色(se)社(she)會(hui)主(zhu)義(yi)思想(xiang)進(jin)(jin)教(jiao)(jiao)材(cai)、進(jin)(jin)課(ke)堂、進(jin)(jin)頭(tou)腦,不斷增(zeng)強(qiang)廣大(da)(da)師生(sheng)中(zhong)國特(te)(te)色(se)社(she)會(hui)主(zhu)義(yi)道路自(zi)信(xin)(xin)(xin)、理(li)論(lun)自(zi)信(xin)(xin)(xin)、制度(du)自(zi)信(xin)(xin)(xin)、文化自(zi)信(xin)(xin)(xin)。以社(she)會(hui)主(zhu)義(yi)核心價值觀(guan)(guan)為(wei)引領,切實(shi)加強(qiang)理(li)想(xiang)信(xin)(xin)(xin)念、愛國主(zhu)義(yi)、集體(ti)主(zhu)義(yi)、中(zhong)國特(te)(te)色(se)社(she)會(hui)主(zhu)義(yi)教(jiao)(jiao)育和(he)中(zhong)華優秀傳(chuan)統文化、革(ge)命傳(chuan)統文化、民族團結教(jiao)(jiao)育,引導(dao)學(xue)(xue)生(sheng)樹立正確(que)的世界觀(guan)(guan)、人(ren)生(sheng)觀(guan)(guan)、價值觀(guan)(guan)。大(da)(da)力開展社(she)會(hui)實(shi)踐和(he)志愿(yuan)服務,積極開展心理(li)健(jian)康教(jiao)(jiao)育。創新(xin)網絡思想(xiang)政治教(jiao)(jiao)育方式(shi),大(da)(da)力弘揚(yang)主(zhu)旋(xuan)律、傳(chuan)播正能量。落實(shi)意識形態(tai)工(gong)(gong)作(zuo)責任制,加強(qiang)講座、論(lun)壇等(deng)陣地建(jian)設和(he)管理(li),牢牢把(ba)握(wo)意識形態(tai)工(gong)(gong)作(zuo)的領導(dao)權、話語權。
三(san)、實施分(fen)類管理
(三)落實分類(lei)(lei)管理政(zheng)策。認真貫徹(che)實施(shi)《中華人(ren)(ren)民(min)(min)(min)(min)(min)共和(he)(he)國(guo)民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)教(jiao)育(yu)促進(jin)法(fa)》,對全省(sheng)民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校實行非營利性(xing)和(he)(he)營利性(xing)分類(lei)(lei)管理。新設民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校,應明(ming)(ming)確按非營利性(xing)或營利性(xing)分類(lei)(lei)審批和(he)(he)登(deng)記。2016年11月7日(ri)《全國(guo)人(ren)(ren)民(min)(min)(min)(min)(min)代表大(da)會(hui)常務委員會(hui)關于修改〈中華人(ren)(ren)民(min)(min)(min)(min)(min)共和(he)(he)國(guo)民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)教(jiao)育(yu)促進(jin)法(fa)〉的決(jue)定》公布前經批準設立的民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校(以(yi)下稱(cheng)現有民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校),應根(gen)據(ju)省(sheng)的工作部(bu)署并結合當(dang)地實際(ji)開展分類(lei)(lei)登(deng)記。教(jiao)育(yu)、人(ren)(ren)力資源社會(hui)保障、民(min)(min)(min)(min)(min)政(zheng)、編制(zhi)(zhi)、工商(shang)等部(bu)門要(yao)抓緊完善(shan)民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校分類(lei)(lei)登(deng)記制(zhi)(zhi)度,細化登(deng)記事項(xiang)及流(liu)程,明(ming)(ming)確民(min)(min)(min)(min)(min)辦(ban)(ban)(ban)學(xue)校變更登(deng)記類(lei)(lei)型(xing)的辦(ban)(ban)(ban)法(fa)和(he)(he)工作規程。
(四)建立平穩(wen)過(guo)渡機制。各(ge)地(di)、各(ge)有(you)關(guan)(guan)(guan)單(dan)位要認(ren)真(zhen)指導現有(you)民辦(ban)(ban)(ban)(ban)(ban)學(xue)校(xiao)(xiao)開展財(cai)務(wu)(wu)清查、清算和(he)章(zhang)程(cheng)修(xiu)訂工(gong)作,按(an)“一校(xiao)(xiao)一策”原則(ze)制定過(guo)渡工(gong)作方案,平穩(wen)有(you)序推(tui)進(jin)分類管理。現有(you)民辦(ban)(ban)(ban)(ban)(ban)學(xue)校(xiao)(xiao)以2017年8月31日為(wei)基準日,在(zai)完成財(cai)務(wu)(wu)清查或(huo)清算及修(xiu)改學(xue)校(xiao)(xiao)章(zhang)程(cheng)后,按(an)照教育部《民辦(ban)(ban)(ban)(ban)(ban)學(xue)校(xiao)(xiao)分類登(deng)(deng)(deng)記(ji)(ji)(ji)實施細則(ze)》(教發(fa)〔2016〕19號(hao))以及省的(de)相關(guan)(guan)(guan)規定進(jin)行分類登(deng)(deng)(deng)記(ji)(ji)(ji);其中,選擇登(deng)(deng)(deng)記(ji)(ji)(ji)為(wei)營利性(xing)學(xue)校(xiao)(xiao)的(de),應在(zai)完成明確(que)財(cai)產權(quan)屬、完善用地(di)手(shou)續、繳納相關(guan)(guan)(guan)稅費、換(huan)發(fa)辦(ban)(ban)(ban)(ban)(ban)學(xue)許可(ke)證、辦(ban)(ban)(ban)(ban)(ban)理民辦(ban)(ban)(ban)(ban)(ban)非企業單(dan)位或(huo)事業單(dan)位注銷(xiao)手(shou)續等(deng)工(gong)作后,到工(gong)商部門登(deng)(deng)(deng)記(ji)(ji)(ji)。含有(you)義務(wu)(wu)教育階段多(duo)層次辦(ban)(ban)(ban)(ban)(ban)學(xue)的(de)現有(you)民辦(ban)(ban)(ban)(ban)(ban)學(xue)校(xiao)(xiao),非義務(wu)(wu)教育階段選擇營利性(xing)辦(ban)(ban)(ban)(ban)(ban)學(xue)的(de),應在(zai)財(cai)務(wu)(wu)清算后進(jin)行資產剝(bo)離(li),并(bing)換(huan)發(fa)辦(ban)(ban)(ban)(ban)(ban)學(xue)許可(ke)證后,到相應的(de)登(deng)(deng)(deng)記(ji)(ji)(ji)機關(guan)(guan)(guan)登(deng)(deng)(deng)記(ji)(ji)(ji)。
(五)健全退(tui)出機(ji)制(zhi)。捐(juan)資舉辦(ban)的(de)民(min)辦(ban)學(xue)(xue)(xue)校終止時(shi),清(qing)償后的(de)剩(sheng)余(yu)財(cai)產統(tong)籌用于教育等事業。現有(you)民(min)辦(ban)學(xue)(xue)(xue)校選擇登記(ji)為(wei)非(fei)營利性(xing)民(min)辦(ban)學(xue)(xue)(xue)校的(de),終止時(shi),學(xue)(xue)(xue)校財(cai)產依(yi)法清(qing)償后有(you)剩(sheng)余(yu)的(de),應根據出資者申請,綜合考慮(lv)2017年8月31日前的(de)出資、取得合理(li)回(hui)報情況以及辦(ban)學(xue)(xue)(xue)效益(yi)、繼(ji)續(xu)辦(ban)學(xue)(xue)(xue)時(shi)間(jian)長短等因素,按(an)(an)“一(yi)校一(yi)策”原則(ze)對出資者進行補償或獎勵,其余(yu)財(cai)產繼(ji)續(xu)用于其他(ta)非(fei)營利性(xing)學(xue)(xue)(xue)校辦(ban)學(xue)(xue)(xue),具體補償或獎勵辦(ban)法由各級教育、人力資源社(she)會保障部門按(an)(an)照審批權限另行制(zhi)定(ding);選擇登記(ji)為(wei)營利性(xing)民(min)辦(ban)學(xue)(xue)(xue)校的(de),終止時(shi),學(xue)(xue)(xue)校財(cai)產依(yi)法清(qing)償后有(you)剩(sheng)余(yu)的(de),依(yi)照《中(zhong)華人民(min)共和(he)國公司法》的(de)有(you)關規(gui)定(ding)處(chu)理(li)。2016年11月7日后設立的(de)民(min)辦(ban)學(xue)(xue)(xue)校,終止時(shi),財(cai)產處(chu)置按(an)(an)照有(you)關規(gui)定(ding)和(he)學(xue)(xue)(xue)校章程處(chu)理(li)。
四、創(chuang)新辦(ban)學體制(zhi)
(六)放寬辦(ban)(ban)(ban)學(xue)準(zhun)入(ru)(ru)條(tiao)件。社會(hui)(hui)力(li)量投(tou)入(ru)(ru)教(jiao)育(yu),凡法律法規沒有(you)禁止以及不損害第三方利益、社會(hui)(hui)公共利益、國家安全的(de)領域(yu),一(yi)律不得進(jin)行限(xian)制。各地要(yao)制定準(zhun)入(ru)(ru)負面清(qing)單,列出禁止和限(xian)制的(de)辦(ban)(ban)(ban)學(xue)行為。各地、各有(you)關單位(wei)要(yao)做好(hao)民(min)辦(ban)(ban)(ban)教(jiao)育(yu)發(fa)展規劃,重(zhong)新梳理(li)民(min)辦(ban)(ban)(ban)學(xue)校準(zhun)入(ru)(ru)條(tiao)件和程序(xu),進(jin)一(yi)步簡政(zheng)放權,吸引更多的(de)社會(hui)(hui)資(zi)源進(jin)入(ru)(ru)教(jiao)育(yu)領域(yu),并優先支持社會(hui)(hui)力(li)量舉辦(ban)(ban)(ban)民(min)辦(ban)(ban)(ban)義務教(jiao)育(yu)學(xue)校和普惠性民(min)辦(ban)(ban)(ban)幼兒(er)園(yuan),增加學(xue)位(wei)供給。
(七)探(tan)索多元主體(ti)(ti)合作辦(ban)(ban)(ban)學(xue)。各地(di)(di)可探(tan)索依(yi)法(fa)利(li)用(yong)國(guo)有(you)資產(chan)(chan)(chan)、集(ji)體(ti)(ti)資產(chan)(chan)(chan)、非(fei)公有(you)資產(chan)(chan)(chan)等,通過合資、合作、參(can)股(gu)、租(zu)賃等方式(shi)與(yu)社(she)(she)會力量(liang)聯合辦(ban)(ban)(ban)學(xue)。支持社(she)(she)會力量(liang)以(yi)協議托管等形式(shi),在不改變所有(you)制(zhi)并明(ming)確(que)各方責(ze)權(quan)利(li)前提下,參(can)與(yu)公辦(ban)(ban)(ban)學(xue)校(xiao)(xiao)(xiao)辦(ban)(ban)(ban)學(xue)。支持國(guo)有(you)資產(chan)(chan)(chan)依(yi)法(fa)參(can)與(yu)舉(ju)辦(ban)(ban)(ban)非(fei)營(ying)利(li)性民(min)辦(ban)(ban)(ban)學(xue)校(xiao)(xiao)(xiao),鼓(gu)勵(li)以(yi)國(guo)有(you)建設(she)用(yong)地(di)(di)使用(yong)權(quan)作價出資或者入股(gu)等方式(shi)提供土地(di)(di)依(yi)法(fa)與(yu)社(she)(she)會資本共同舉(ju)辦(ban)(ban)(ban)民(min)辦(ban)(ban)(ban)學(xue)校(xiao)(xiao)(xiao)。國(guo)有(you)資產(chan)(chan)(chan)監管機構要對民(min)辦(ban)(ban)(ban)學(xue)校(xiao)(xiao)(xiao)中的國(guo)有(you)資產(chan)(chan)(chan)加強監管,防止國(guo)有(you)資產(chan)(chan)(chan)流失(shi)。
(八)拓寬辦(ban)學(xue)籌融(rong)資渠道。鼓(gu)(gu)勵和吸引社會(hui)資金(jin)進入(ru)教育領(ling)域舉(ju)辦(ban)學(xue)校(xiao)或投入(ru)項目建設(she)。鼓(gu)(gu)勵各類(lei)社會(hui)組織和個人對非營利性(xing)民辦(ban)學(xue)校(xiao)給予捐贈(zeng)。鼓(gu)(gu)勵民辦(ban)學(xue)校(xiao)設(she)立學(xue)校(xiao)發展(zhan)基(ji)金(jin)。探(tan)索辦(ban)理民辦(ban)學(xue)校(xiao)未來經營收入(ru)、知(zhi)識產權質(zhi)押(ya)貸款(kuan)(kuan)業務,提供銀行貸款(kuan)(kuan)、信托等多樣化金(jin)融(rong)服務。允許(xu)營利性(xing)民辦(ban)學(xue)校(xiao)探(tan)索利用多層(ceng)次(ci)資本市(shi)場開展(zhan)股權融(rong)資。
五、加大政策支持(chi)
(九)加大財政投(tou)入力度。各地級(ji)以上市、縣(市、區)政府要(yao)按照《中華人民(min)共(gong)和(he)國(guo)(guo)預算法(fa)(fa)(fa)》《中華人民(min)共(gong)和(he)國(guo)(guo)教(jiao)(jiao)育(yu)法(fa)(fa)(fa)》《中華人民(min)共(gong)和(he)國(guo)(guo)民(min)辦(ban)教(jiao)(jiao)育(yu)促進法(fa)(fa)(fa)》等法(fa)(fa)(fa)律法(fa)(fa)(fa)規規定,因地制(zhi)宜,調整(zheng)優(you)化教(jiao)(jiao)育(yu)支出結構,不斷加大對民(min)辦(ban)教(jiao)(jiao)育(yu)的扶(fu)持力度。縣級(ji)以上政府要(yao)設立民(min)辦(ban)教(jiao)(jiao)育(yu)發(fa)展(zhan)專項資金(jin)(jin),資助民(min)辦(ban)教(jiao)(jiao)育(yu)發(fa)展(zhan)。各級(ji)財政扶(fu)持民(min)辦(ban)教(jiao)(jiao)育(yu)發(fa)展(zhan)的資金(jin)(jin)要(yao)納(na)入預算,并向社(she)會公開,接受審計和(he)社(she)會監(jian)督,提高資金(jin)(jin)使用(yong)效益。
(十(shi))健全(quan)政府扶(fu)持獎勵(li)機制。各地(di)級以上市(shi)、縣(市(shi)、區)政府要建立健全(quan)政府補貼(tie)制度,創(chuang)新財政補貼(tie)方式,探索對民辦(ban)學(xue)(xue)(xue)校給予經費(fei)(fei)(fei)獎補,明確補貼(tie)的(de)(de)項目、對象、標(biao)準、用途;要按(an)不低于公(gong)辦(ban)義(yi)務(wu)教育學(xue)(xue)(xue)校生(sheng)均(jun)公(gong)用經費(fei)(fei)(fei)的(de)(de)標(biao)準補助民辦(ban)義(yi)務(wu)教育學(xue)(xue)(xue)校,對按(an)規定(ding)(ding)可繼續向(xiang)學(xue)(xue)(xue)生(sheng)收取學(xue)(xue)(xue)費(fei)(fei)(fei)的(de)(de),須(xu)扣除公(gong)用經費(fei)(fei)(fei)補助標(biao)準部分;完(wan)善政府購(gou)買(mai)服務(wu)的(de)(de)標(biao)準和程(cheng)序(xu),制定(ding)(ding)向(xiang)民辦(ban)學(xue)(xue)(xue)校購(gou)買(mai)學(xue)(xue)(xue)位、課程(cheng)教材、科研成果、職業(ye)培(pei)訓(xun)、政策咨(zi)詢等教育服務(wu)的(de)(de)具體辦(ban)法(fa),建立績(ji)效評價制度。鼓勵(li)各地(di)加大(da)對普惠性民辦(ban)幼兒(er)園的(de)(de)扶(fu)持力度。
(十(shi)一)落實(shi)差別化用(yong)(yong)(yong)地(di)(di)(di)(di)(di)政策(ce)。民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)建(jian)設(she)(she)用(yong)(yong)(yong)地(di)(di)(di)(di)(di)按(an)科(ke)教(jiao)用(yong)(yong)(yong)地(di)(di)(di)(di)(di)管理,納入土(tu)(tu)地(di)(di)(di)(di)(di)利(li)(li)用(yong)(yong)(yong)總(zong)體規(gui)劃(hua)、城(cheng)鄉規(gui)劃(hua)和(he)土(tu)(tu)地(di)(di)(di)(di)(di)利(li)(li)用(yong)(yong)(yong)年度計(ji)劃(hua)。各(ge)地(di)(di)(di)(di)(di)在分(fen)配新增建(jian)設(she)(she)用(yong)(yong)(yong)地(di)(di)(di)(di)(di)指標時要適當向民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)傾(qing)斜,新建(jian)民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)的(de)教(jiao)育(yu)教(jiao)學設(she)(she)施用(yong)(yong)(yong)地(di)(di)(di)(di)(di)申(shen)報新增建(jian)設(she)(she)用(yong)(yong)(yong)地(di)(di)(di)(di)(di),符合(he)土(tu)(tu)地(di)(di)(di)(di)(di)利(li)(li)用(yong)(yong)(yong)總(zong)體規(gui)劃(hua)和(he)城(cheng)鄉規(gui)劃(hua)的(de),要在土(tu)(tu)地(di)(di)(di)(di)(di)利(li)(li)用(yong)(yong)(yong)年度規(gui)劃(hua)中(zhong)優先安排(pai)。非(fei)營利(li)(li)性(xing)民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)供(gong)(gong)地(di)(di)(di)(di)(di)方(fang)式(shi)及規(gui)費減免享受公辦(ban)學校(xiao)(xiao)(xiao)(xiao)同(tong)等政策(ce),符合(he)《劃(hua)撥用(yong)(yong)(yong)地(di)(di)(di)(di)(di)目錄》的(de)民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)設(she)(she)施用(yong)(yong)(yong)地(di)(di)(di)(di)(di),按(an)劃(hua)撥方(fang)式(shi)供(gong)(gong)地(di)(di)(di)(di)(di),其(qi)(qi)他用(yong)(yong)(yong)地(di)(di)(di)(di)(di)實(shi)行有(you)(you)償使(shi)用(yong)(yong)(yong)。營利(li)(li)性(xing)民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)按(an)國家相應(ying)(ying)政策(ce)供(gong)(gong)給土(tu)(tu)地(di)(di)(di)(di)(di),同(tong)一宗用(yong)(yong)(yong)地(di)(di)(di)(di)(di)有(you)(you)兩個(ge)或兩個(ge)以(yi)上用(yong)(yong)(yong)地(di)(di)(di)(di)(di)申(shen)請人(ren)的(de),應(ying)(ying)當以(yi)招標、拍(pai)賣或者掛牌(pai)方(fang)式(shi)供(gong)(gong)地(di)(di)(di)(di)(di);只有(you)(you)一個(ge)申(shen)請人(ren)的(de),可以(yi)協(xie)議出(chu)讓(rang)方(fang)式(shi)供(gong)(gong)地(di)(di)(di)(di)(di)。民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)通(tong)(tong)過招標、拍(pai)賣、掛牌(pai)或協(xie)議出(chu)讓(rang)方(fang)式(shi)取得的(de)土(tu)(tu)地(di)(di)(di)(di)(di),土(tu)(tu)地(di)(di)(di)(di)(di)出(chu)讓(rang)金可在規(gui)定(ding)期(qi)限內(nei)按(an)合(he)同(tong)約定(ding)分(fen)期(qi)繳納。現(xian)有(you)(you)民(min)(min)辦(ban)學校(xiao)(xiao)(xiao)(xiao)選擇登記為營利(li)(li)性(xing)學校(xiao)(xiao)(xiao)(xiao)的(de),其(qi)(qi)通(tong)(tong)過劃(hua)撥方(fang)式(shi)取得的(de)用(yong)(yong)(yong)地(di)(di)(di)(di)(di),應(ying)(ying)按(an)規(gui)定(ding)實(shi)行有(you)(you)償使(shi)用(yong)(yong)(yong),繳納土(tu)(tu)地(di)(di)(di)(di)(di)出(chu)讓(rang)金。土(tu)(tu)地(di)(di)(di)(di)(di)使(shi)用(yong)(yong)(yong)權人(ren)申(shen)請改變(bian)全部或者部分(fen)土(tu)(tu)地(di)(di)(di)(di)(di)用(yong)(yong)(yong)途(tu)的(de),政府應(ying)(ying)當將(jiang)申(shen)請改變(bian)用(yong)(yong)(yong)途(tu)的(de)土(tu)(tu)地(di)(di)(di)(di)(di)收回,按(an)時價定(ding)價,重新依法(fa)供(gong)(gong)應(ying)(ying)。
(十(shi)二)落實稅(shui)(shui)(shui)(shui)費優(you)惠(hui)激勵政(zheng)策(ce)。非(fei)營利性民(min)辦(ban)學校享(xiang)受(shou)與公辦(ban)學校同等(deng)的(de)稅(shui)(shui)(shui)(shui)收優(you)惠(hui)政(zheng)策(ce),營利性民(min)辦(ban)學校享(xiang)受(shou)國家規定(ding)的(de)稅(shui)(shui)(shui)(shui)收優(you)惠(hui)政(zheng)策(ce)。對企業支(zhi)(zhi)持教(jiao)(jiao)育(yu)事業的(de)公益(yi)性捐(juan)贈(zeng)(zeng)支(zhi)(zhi)出,按照稅(shui)(shui)(shui)(shui)法有(you)關規定(ding),在(zai)年度利潤(run)總(zong)(zong)額(e)12%以內(nei)的(de)部分,準予在(zai)計算應納(na)稅(shui)(shui)(shui)(shui)所(suo)(suo)得額(e)時扣除。超過(guo)年度利潤(run)總(zong)(zong)額(e)12%的(de)部分,準予結轉(zhuan)以后三(san)年內(nei)在(zai)計算應納(na)稅(shui)(shui)(shui)(shui)所(suo)(suo)得額(e)時扣除。個人將其(qi)所(suo)(suo)得通過(guo)中(zhong)國境內(nei)的(de)公益(yi)性社會組(zu)織、縣級以上(shang)政(zheng)府及其(qi)組(zu)成部門和直屬機構向教(jiao)(jiao)育(yu)事業的(de)捐(juan)贈(zeng)(zeng),按規定(ding)在(zai)個人所(suo)(suo)得稅(shui)(shui)(shui)(shui)應納(na)稅(shui)(shui)(shui)(shui)所(suo)(suo)得額(e)中(zhong)全(quan)額(e)扣除。對民(min)辦(ban)學校自(zi)用的(de)房產、土地,免(mian)征房產稅(shui)(shui)(shui)(shui)、城鎮土地使用稅(shui)(shui)(shui)(shui)。
(十三)實(shi)行分類(lei)收(shou)費(fei)政策。按(an)照市場化改(gai)革方向擴大民(min)辦學(xue)校收(shou)費(fei)自主(zhu)權(quan)。義務教育階段民(min)辦學(xue)校的收(shou)費(fei),原則上(shang)實(shi)行政府定價(jia)(jia),視相(xiang)關改(gai)革進(jin)程(cheng)(cheng)及市場競爭程(cheng)(cheng)度適時放開;其(qi)余各(ge)級各(ge)類(lei)民(min)辦學(xue)校收(shou)費(fei)實(shi)行市場調節價(jia)(jia)。民(min)辦學(xue)校可以按(an)學(xue)期或學(xue)年收(shou)費(fei),收(shou)費(fei)項目、標準(zhun)和(he)方式應在(zai)招生(sheng)報名開始前不(bu)少于30天(tian)向社會(hui)公示(shi),不(bu)得在(zai)公示(shi)項目和(he)標準(zhun)之外收(shou)取其(qi)他費(fei)用。
六、健全管理制度(du)

(十五)保(bao)障受(shou)(shou)教(jiao)育(yu)者權(quan)益。依(yi)法保(bao)障學(xue)生的受(shou)(shou)教(jiao)育(yu)權(quan)、教(jiao)育(yu)選擇(ze)權(quan)以及(ji)對(dui)學(xue)校辦(ban)學(xue)管理的知情權(quan)、參與權(quan)。民(min)辦(ban)學(xue)校的受(shou)(shou)教(jiao)育(yu)者在(zai)升學(xue)、就業(ye)、社會(hui)優待、接受(shou)(shou)資(zi)(zi)助以及(ji)評(ping)選表(biao)彰等(deng)方(fang)面享有(you)同級同類公辦(ban)學(xue)校受(shou)(shou)教(jiao)育(yu)者的同等(deng)權(quan)利。民(min)辦(ban)學(xue)校應(ying)落實從(cong)學(xue)費收(shou)入中提取不少于(yu)5%的資(zi)(zi)金用于(yu)獎勵和資(zi)(zi)助學(xue)生的規定。鼓勵企事業(ye)單位、社會(hui)組織和個人面向民(min)辦(ban)學(xue)校設立獎助學(xue)金。
(十六)保(bao)障教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)權益。依(yi)法(fa)保(bao)障和落(luo)實民(min)(min)辦(ban)(ban)學(xue)校教(jiao)(jiao)(jiao)師職(zhi)(zhi)稱評定、科研(yan)立項等方面享有與(yu)公(gong)辦(ban)(ban)學(xue)校教(jiao)(jiao)(jiao)師同等權利。建立健全政府、學(xue)校、個人合理分擔(dan)的(de)民(min)(min)辦(ban)(ban)學(xue)校教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)社(she)會保(bao)障機制(zhi),保(bao)障教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)的(de)社(she)會保(bao)險(xian)待遇。民(min)(min)辦(ban)(ban)學(xue)校應當(dang)與(yu)教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)簽訂合同,按(an)時足(zu)額發放(fang)教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)的(de)薪酬,依(yi)法(fa)繳(jiao)納社(she)會保(bao)險(xian)費(fei)和足(zu)額繳(jiao)存住房公(gong)積(ji)金。支(zhi)持有條件的(de)地區發放(fang)民(min)(min)辦(ban)(ban)學(xue)校教(jiao)(jiao)(jiao)師從教(jiao)(jiao)(jiao)津貼。鼓勵民(min)(min)辦(ban)(ban)學(xue)校為教(jiao)(jiao)(jiao)職(zhi)(zhi)工(gong)(gong)(gong)建立年金等補充養老保(bao)險(xian),提高(gao)教(jiao)(jiao)(jiao)師退休待遇。
(十(shi)七)保(bao)障(zhang)舉辦(ban)者權(quan)益(yi)。保(bao)障(zhang)民辦(ban)學校的(de)舉辦(ban)者或其代表(biao)依照政策法規(gui)和(he)學校章程(cheng)規(gui)定的(de)權(quan)限及程(cheng)序參與(yu)辦(ban)學和(he)管理。保(bao)障(zhang)舉辦(ban)者依法按章選擇登(deng)記類型、日常(chang)運營管理、重大事項變更、獲取(qu)勞動報酬(chou)、獲得補償(chang)或獎(jiang)勵(li)等權(quan)利。
(十八)健全資產(chan)財務管理制度。民(min)辦(ban)(ban)學(xue)校應(ying)(ying)落實年(nian)度預算、決算報告報備(bei)制度,將(jiang)舉辦(ban)(ban)者出(chu)資、政府補(bu)助、收費、受贈、辦(ban)(ban)學(xue)積(ji)累等各類資產(chan)分類登記入賬(zhang),每個會計年(nian)度開展(zhan)資產(chan)清(qing)查,并(bing)將(jiang)清(qing)查結(jie)果(guo)向社會公布。建立健全民(min)辦(ban)(ban)學(xue)校第(di)三方審計制度、信息(xi)公開制度和違規失信懲戒機制。民(min)辦(ban)(ban)學(xue)校收取(qu)的費用應(ying)(ying)當主要用于教育教學(xue)活動(dong)、改善辦(ban)(ban)學(xue)條件(jian)和保障教職工待遇;應(ying)(ying)當全部納(na)入學(xue)校財務專戶,并(bing)按照(zhao)有關規定向受教育者出(chu)具(ju)相應(ying)(ying)票據。
(十九)完(wan)善風險(xian)防(fang)(fang)范機制(zhi)。各地級以上市(shi)、縣(市(shi)、區)政(zheng)府(fu)及民(min)辦(ban)(ban)學校(xiao)(xiao)要建立完(wan)善風險(xian)防(fang)(fang)范和應急處置機制(zhi),制(zhi)定(ding)預案(an),重點(dian)防(fang)(fang)范和化解因經營(ying)管理不善、重大變更及終止辦(ban)(ban)學引發的(de)(de)風險(xian)。探索(suo)建立民(min)辦(ban)(ban)學校(xiao)(xiao)聯合保(bao)險(xian)制(zhi)度。各地和各民(min)辦(ban)(ban)學校(xiao)(xiao)要落(luo)實安全(quan)(quan)管理責(ze)任和安全(quan)(quan)工(gong)(gong)作專(zhuan)項經費,按(an)照有關規(gui)定(ding)購買校(xiao)(xiao)方責(ze)任、校(xiao)(xiao)車(che)承運人(ren)責(ze)任等保(bao)險(xian)。民(min)辦(ban)(ban)學校(xiao)(xiao)的(de)(de)法定(ding)代表人(ren)要履(lv)行學校(xiao)(xiao)安全(quan)(quan)管理和穩定(ding)工(gong)(gong)作第一責(ze)任人(ren)的(de)(de)職責(ze),組織落(luo)實好(hao)人(ren)防(fang)(fang)、物防(fang)(fang)、技防(fang)(fang)建設和矛盾糾紛排查(cha)化解等工(gong)(gong)作,確保(bao)校(xiao)(xiao)園安全(quan)(quan)穩定(ding)。
七(qi)、提(ti)高教育質量
(二十)提升(sheng)教(jiao)(jiao)師(shi)隊伍水平(ping)。教(jiao)(jiao)育(yu)(yu)、人(ren)力(li)資(zi)源社會保障部門要將民(min)辦(ban)(ban)學(xue)校(xiao)教(jiao)(jiao)師(shi)與公(gong)辦(ban)(ban)學(xue)校(xiao)教(jiao)(jiao)師(shi)納入同(tong)(tong)系列(lie)、同(tong)(tong)要求、同(tong)(tong)待(dai)遇的(de)師(shi)資(zi)培訓(xun)計(ji)劃(hua),民(min)辦(ban)(ban)學(xue)校(xiao)要在經(jing)費和時間(jian)上(shang)予以保障。民(min)辦(ban)(ban)學(xue)校(xiao)要重視中青(qing)年教(jiao)(jiao)師(shi)隊伍建設(she),加大對教(jiao)(jiao)育(yu)(yu)教(jiao)(jiao)學(xue)研究的(de)支持(chi)力(li)度。支持(chi)符合條件(jian)的(de)高(gao)層次人(ren)才到民(min)辦(ban)(ban)學(xue)校(xiao)任教(jiao)(jiao)。完善公(gong)辦(ban)(ban)、民(min)辦(ban)(ban)學(xue)校(xiao)教(jiao)(jiao)師(shi)合理流(liu)動(dong)機制,鼓勵公(gong)辦(ban)(ban)學(xue)校(xiao)選派優(you)秀教(jiao)(jiao)師(shi)到有需要的(de)民(min)辦(ban)(ban)學(xue)校(xiao)幫教(jiao)(jiao)扶(fu)教(jiao)(jiao)。
(二十一)提高(gao)人(ren)才(cai)培(pei)養(yang)質量(liang)。積(ji)極引(yin)導民辦學(xue)校(xiao)服務社會(hui)需求(qiu),明確發展定位,創新辦學(xue)模式,分(fen)類分(fen)層發展。支(zhi)持民辦學(xue)校(xiao)更新辦學(xue)理念,深(shen)化教(jiao)(jiao)育(yu)(yu)教(jiao)(jiao)學(xue)改革,加(jia)強內涵建(jian)(jian)(jian)設(she),培(pei)育(yu)(yu)學(xue)校(xiao)特色,提高(gao)辦學(xue)質量(liang)。從(cong)事學(xue)歷教(jiao)(jiao)育(yu)(yu)的民辦學(xue)校(xiao),應當建(jian)(jian)(jian)立教(jiao)(jiao)育(yu)(yu)教(jiao)(jiao)學(xue)質量(liang)保障體系,按照國(guo)家課(ke)(ke)程標(biao)準和學(xue)校(xiao)人(ren)才(cai)培(pei)養(yang)方案,開齊(qi)開足課(ke)(ke)程,不得隨(sui)意增(zeng)減課(ke)(ke)程、課(ke)(ke)時(shi)和學(xue)分(fen)。支(zhi)持民辦高(gao)等(deng)學(xue)校(xiao)參(can)加(jia)專業認(ren)證和國(guo)際認(ren)證。推進管辦評(ping)分(fen)離(li),建(jian)(jian)(jian)立民辦學(xue)校(xiao)第三方質量(liang)認(ren)證和評(ping)估制度,實現人(ren)才(cai)培(pei)養(yang)質量(liang)的常態監測與定期評(ping)估有(you)機結(jie)合,推動人(ren)才(cai)培(pei)養(yang)質量(liang)不斷提升。
八(ba)、提升管理服(fu)務水平
(二十二)強化部門協(xie)調(diao)。建立由省教育(yu)廳(ting)(ting)牽(qian)頭,省編辦(ban)(ban)、發(fa)展改革委、公安廳(ting)(ting)、民政(zheng)廳(ting)(ting)、財政(zheng)廳(ting)(ting)、人力(li)資(zi)源社會(hui)保障廳(ting)(ting)、國(guo)土資(zi)源廳(ting)(ting)、住房城鄉建設廳(ting)(ting)、審(shen)計(ji)廳(ting)(ting)、國(guo)資(zi)委、地(di)稅局、工商局、金融辦(ban)(ban)和省國(guo)稅局、人民銀行廣州分行、廣東銀監局、廣東證監局、廣東保監局等(deng)部門參(can)加(jia)的部門間工作(zuo)聯席會(hui)議制(zhi)(zhi)度,協(xie)調(diao)解(jie)決(jue)民辦(ban)(ban)教育(yu)發(fa)展中遇到(dao)的困難和問題(ti)。各(ge)地(di)要參(can)照省的做(zuo)法建立相應的工作(zuo)機制(zhi)(zhi)。把鼓勵支持社會(hui)力(li)量興辦(ban)(ban)教育(yu)情況,作(zuo)為(wei)各(ge)地(di)級以上市、縣(市、區)政(zheng)府改進公共服務方式考核和履(lv)行教育(yu)職責評(ping)價的重要內容。
(二十三)加(jia)強管(guan)理服(fu)(fu)務(wu)(wu)。加(jia)強民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)管(guan)理機構建設,減少(shao)民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)的事前審批,加(jia)強事中(zhong)事后監(jian)管(guan),加(jia)強各(ge)監(jian)管(guan)部(bu)門之間的協(xie)(xie)同配合(he)(he),提(ti)(ti)高(gao)監(jian)管(guan)能力和(he)(he)服(fu)(fu)務(wu)(wu)水平。建立民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)管(guan)理信息系統,推(tui)(tui)動(dong)管(guan)理事項網上并聯辦(ban)(ban)理,提(ti)(ti)高(gao)服(fu)(fu)務(wu)(wu)效率(lv)。認真落(luo)實《中(zhong)華人民(min)共和(he)(he)國民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)促進(jin)法》有關對(dui)民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)發展做出突出貢獻的集體和(he)(he)個人開展表(biao)彰獎勵的規定。積極發揮(hui)各(ge)級民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)協(xie)(xie)會等行(xing)業組織在承接政府購買(mai)服(fu)(fu)務(wu)(wu)、促進(jin)行(xing)業自律、推(tui)(tui)動(dong)交流合(he)(he)作等方面的重要作用(yong)。做好民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)涉(she)外(wai)活(huo)動(dong)的管(guan)理與服(fu)(fu)務(wu)(wu)。民(min)辦(ban)(ban)高(gao)校的涉(she)外(wai)論(lun)壇講座、外(wai)籍教(jiao)師聘任、引進(jin)教(jiao)材選用(yong)等,要嚴(yan)格執(zhi)行(xing)涉(she)外(wai)管(guan)理的有關規定。支持民(min)辦(ban)(ban)教(jiao)育(yu)(yu)(yu)研究平臺(tai)和(he)(he)高(gao)水平研究團隊建設,推(tui)(tui)動(dong)研究成果(guo)轉(zhuan)化應用(yong)。
